How legal entities and individuals will be able to postpone their installment payments for up to 9 months

Legal entities and individuals can request a deferral of loan installment payments for a period of up to nine months.

However, only legal and natural persons who can prove that they have been affected by the financial crisis will be able to do so.

Legal entities will have to submit a declaration on their own responsibility regarding the impact, in the sense of a decrease, by at least 25%, of the average monthly results for the last 3 months prior to the request for the suspension of payment obligations compared to the similar period in 2021, Antena 3 announces.

In the case of debtors that do not have a similar reporting period in 2021, being established less than a year ago, the analysis will be carried out by reporting to the average results since establishment, regarding the commitment not to distribute/pay dividends and not to grant or reimburse loans to shareholders during the period of application of the payment deferral facility, with the exception of public enterprises as defined in Emergency Ordinance no. 109/2011.

Creditors must ensure that the respective debtors have not registered payment incidents with the Payment Incidents Central Office in relation to promissory notes or checks, in the last six months prior to the date of the request, and that they do not register a net asset level below a value equal to half of the share capital, according to the annual financial statements as of 31.12.2021.

Also, individuals will have to submit a declaration on their own responsibility regarding the fact that they have registered an increase of at least 25% in average monthly expenses in the last 3 months prior to requesting the suspension of payment obligations compared to the similar period in 2021.
