Latest news about e-VAT: What changes occurred after the meeting with CECCAR representatives

The Minister of Finance, Marcel Boloş, presents the changes regarding the pre-filled VAT return, following Wednesday's working meeting with representatives of the Body of Certified Accountants and Authorized Accountants of Romania

"I'm back with news on the topic of the pre-filled VAT return, a vital tool for combating tax evasion and collecting the amounts actually owed to the consolidated state budget.

First of all, I would like to address all the accounting experts in the country, expressing my respect for your work and the essential role you play in the financial ecosystem. I thank those who have sent constructive messages on this topic, I assure you that I have carefully addressed the concerns you have raised with me.
Regarding communication with you, although it is obvious that we have not been able to achieve the need for consultation that the adoption of such a measure requires, at the level of the Ministry of Finance, the business environment was consulted and invited repeatedly to working sessions and was able to actively contribute to the development of the rules necessary for completing the pre-filled return and the electronic form template.

However, we are committed to adapting and improving this initiative based on your needs and suggestions. That is why, yesterday, we had a working meeting with representatives of the Body of Certified Public Accountants and Authorized Accountants of Romania, in which we agreed on the following:

1) Repeal of the provisions relating to the justification note regarding VAT differences provided for in art. 6 of GEO 70/2024;
2) Extension of the entry into force date for VAT difference notes and replacement of the justification note for VAT differences with the compliance notification adapted to the e-VAT mode, provided for by art. 121, paragraph (1) of the Fiscal Procedure Code;
3) Extension of the deadline for notification of compliance for VAT differences until the 25th of the following month for the previous month;
4) Review of the amount of fines.

Further, today, discussions with representatives of the business environment will continue at the Ministry of Finance headquarters.

Also, following the messages received from you, I would like to clarify the following:

✅ An important aspect requested by the business environment is the set of reports from ANAF's IT systems, which will allow calibration of accounting records and the preparation/reporting of the value added tax return in accordance with the fiscal situation. Taxable persons will have at their disposal reports on the data and information from the data sources used regarding the operations carried out in the reporting month.
✅ Since until the full implementation of the national RO e-SAF-T IT system, there is not sufficient data for pre-filling the e-VAT return for persons applying the VAT system upon receipt, the deadline from which the pre-filled RO e-VAT return will be used for these persons is August 1, 2025.
✅ Precisely in order to have a period of adjustment to the rigors of the measures established, a transitional period has been provided until the beginning of next year, during which the effects of sanctioning the failure to transmit the response to the compliance notification regarding RO e-VAT differences and the implications regarding the establishment of the tax risk for taxable persons registered for VAT purposes are suspended.

"Thank you for your contribution and patience during this period in which we want the reduction of tax evasion through effective measures to reduce the VAT gap to no longer be just a slogan, but a problem with profound implications for the economic well-being of all Romanians and the proper functioning of the fiscal and economic system as a whole," a statement from the Minister of Finance states.
